How long does the process usually take?
The pre-legal process can take up to 21 days although most
payments are made after the initial letter.
How successful is the debt collection
procedure?
On average, 85% of debts are paid after the first letter is
sent. If the debt is not paid after 21 days it is often prudent
to consider whether further action will be suitable.
What happens if the debt is disputed?
We can attempt to negotiate a settlement on your behalf. It
would then be your decision as to whether to accept this offer.
How is it decided whether the debt
should go to litigation?
We will work with you to decide whether litigation is the
suitable course of action. Some points to consider might be:-
· If we cannot establish the true identity of the debtor
· It is known that the debtor has no money
· The debt is disputed and you cannot substantiate
the claim
· The company has gone into Receivership/Administration
What happens if the company are in
Liquidation/Receivership?
We are able to clarify whether the company has genuinely gone
into receivership, etc. If this is the case, we will ensure
that you are informed of all meetings, other creditors, etc.
Will I see copies of correspondence?
We will send you copies of all e-mail and written correspondence
between ourselves and the debtor.
When will I be invoiced?
You will be invoiced in event of the following situations:
· The debt has been resolved by payment of monies to
either us or directly to you.
· It is agreed that a part-payment is acceptable to
you as settlement of the account.
· Judgement has been awarded or a credit note raised.
· A judgement has been obtained and it is agreed that
the debtors assets be secured.
· The action is halted by yourselves without good reason.
Can you provide legal advice?
No, you would need to discuss more complicated situations
with a solicitor.
Is VAT charged?
Yes. As the service is performed within the UK, tax applies.
Can I reclaim fees?
All court fees can be reclaimed as these are added to your
claim. Our fees, however, cannot be claimed unless you have
a previous arrangement with your debtor to cover such costs.
